THE WARSAW UNIVERSITY MANAGEMENT DEPARTMENT SYNERGIA PORTAL REGULATIONS FOR STUDENTS, GRADUATES AND EMPLOYEES OF THE WARSAW UNIVERSITY MANAGEMENT FACULTY, EMPLOYERS AND EXPERTS
I. General provisions and definitions
§1
These regulations specify the terms and conditions of using the Synergia Portal of the Faculty of Management at the University of Warsaw, available at www.synergia.wz.uw.edu.pl, by students, graduates, and employees of the Faculty of Management at the University of Warsaw, hereinafter referred to as "WZ UW", as well as experts and representatives of companies registered in the Portal.
§2
The terms used in these Regulations will have the following definitions:
- Regulations – these Regulations for the use of the WZ UW Synergia Portal;
- Portal – the WZ UW Synergia Portal, available at the following website: www.synergia.wz.uw.edu.pl; intended for students, graduates and employees of WZ UW, as well as registered employers and experts;
- The Portal Owner – WZ UW, located at: 1/3 Szturmowa Street, 02-678 Warsaw;
- Administrators – persons responsible for the maintenance of the WZ UW Synergia Portal;
- User – a natural or legal person who is a registered user of the Portal;
- Employer – a natural or legal person, as well as another organizational unit without legal personality, which employs workers and is a registered user of the Portal;
- Expert – a natural person who is an expert in a given field and is a registered user of the Portal;
- Account – entry in the Synergy Portal database, which confirms the fact of acquiring the status and rights of a User with the possibility of accessing the services after providing their login and password, as well as to modify the data published by the User in the Account and the Account settings;
- Data – content and photographs which the User voluntarily places in the Portal;
- Business Card of the Expert - space made available by the Portal on the server which the Expert inserts selected Data into and within which he/she administers them;
- Agreement – the Agreement concluded between the Portal Owner and User or Employer, which these Regulations are an integral part of, by means of statements of will made by the parties during the registration process in the Portal;
- Registration – the process of concluding the Agreement.
II. General provisions and definitions
§3
A natural person with full legal capacity, as well as a legal person or an organizational unit without legal personality, for which legal capacity is granted by law, provided that a person with the right to represent such an entity performs the Registration on its behalf, may participate in the Registration.
By registering, the User, Employer, or Expert accepts all the terms and conditions of the Regulations and undertakes to comply with them for the duration of the concluded Agreement.
After the Registration the User acquires the right to use the services available in the Portal, such as:
1) creating and editing the User’s Account;
2) CV generator - creating and storing CVs in the database, as well as adding their own files with application documents;
3) browsing, searching for and replying to job, internship, and apprenticeship offers;
4) getting access to the list of offers which the User has applied for;
5) activating a newsletter with job offers;
6) activating the newsletter with general information.
After Registration, the Employer acquires the rights to use the services available in the Portal, i.e.:
1) creating and editing their own Employer Account;
2) free publication of internship and apprenticeship offers in the Portal;
3) free publication of job offers with a presentation time of up to 3 weeks in the Portal;
4) managing the job offers published by them.
After Registration, the Expert acquires the rights to use the services available in the Portal, i.e.:
1) creating and editing the Expert’s Account;
2) creating and editing the Expert’s Business Card.
§4
During the Registration process it is required to fill in the Portal's registration form by providing true data and accepting the Regulations.
Failure to fill in the fields marked as mandatory leads to failure to complete the Registration process.
The fields must contain only the data that are required in a given field. Deleting data from a mandatory field results in losing the possibility of using the Portal.
§5
Users who do not have an account in the USOS system fill in the registration form. After verifying the data provided in the form, the Administrator accepts or rejects the User's Registration request.
If the Administrator finds that the User, Employer, or Expert has provided false or outdated data, he/she has the right to:
1) order the User, Employer, or Expert to remove the incorrect data immediately;
2) block the User, Employer, or Expert Account until the incorrect data is removed;
3) delete the User, Employer, or Expert Account.
If there is reasonable doubt about the accuracy of the data entered by the User, Employer, or Expert, the Administrator has the right to request the presentation of relevant documents to confirm these data.
If a User, Employer, or Expert has used the data of a third party without their consent, that person can request the Administrator to delete the Account containing their data.
§6
The User, Employer, or Expert can have only one Account.
The User, Employer, or Expert cannot share the Account with other Users, Employers, or Experts or use the Accounts of other Users, Employers, or Experts.
The User, Employer, or Expert has the right to terminate the Agreement by sending a request to the Administrator to remove the Account. The Account removal procedure takes place within 72 hours of the request.
III. Agreement
§7
From the moment of creating a User, Employer, or Expert Account, an Agreement is concluded between the User, Employer, or Expert and the Portal Owner, on the basis of which the User, Employer, or Expert undertakes to comply with the Regulations terms, while the Portal Owner undertakes to provide services within the Portal.
The services are provided only to registered Users, Employers, or Experts after they have logged into their Account.
Every User, Employer, and Expert can terminate the Agreement immediately without giving any reason.
The Agreement is terminated by deleting the User, Employer, or Expert Account.
§8
All services provided by the Portal Owner are free of charge.
§9
The Portal Owner reserves the right to modify the services and the way the Portal functions, to cease activity, to transfer the rights to the Portal, and to take any actions related to the Portal which are allowed by the law.
§10
In accordance with Article 13 of the Regulation 2016/679 of the European Parliament and of the (EU) Council dated April 27, 2016 on the protection of natural persons with regard to the processing of personal data - General Data Protection Regulation (OJ EU L 119/1 of May 4, 2016), hereinafter referred to as GDPR, the University of Warsaw informs that:
The personal data administrator is the University of Warsaw with its registered office at 26/28 Krakowskie Przedmieście, 00-927 Warsaw. The personal data administrator can be contacted using one of the contact forms available at: http://www.wz.uw.edu.pl/
The administrator appointed a Data Protection Inspector (DPI), who can be contacted in matters concerning personal data. You can contact the DPI by sending an email to: iod@adm.uw.edu.pl.
Personal data will be processed for the purpose of using the WZ UW Synergia Portal through email correspondence on the basis of Article 6(1)(e) of the GDPR, as well as for the purpose of investigating, establishing, and defending possible claims related to the use of the Portal on the basis of Article 6(1)(f) of the GDPR.
Personal data will be processed by the University of Warsaw until the account is deleted from the WZ UW Synergia Portal, and then for the period of the expiry of possible civil law claims.
The recipients of the data will be authorised employees and collaborators of the University of Warsaw, units cooperating with WZ UW, WZ UW partners and companies providing services to WZ UW, which WZ UW has signed a personal data entrustment agreement with.
We guarantee the fulfilment of all rights under the GDPR, i.e., the right of access to data and their rectification and deletion, as well as the restriction of processing. If Users, Employers, or Experts consider that the processing of personal data violates the provisions of GDPR, they have the right to lodge a complaint to the President of the Office for Personal Data Protection.
Providing personal data is necessary for the creation of an account and the use of WZ UW Synergia Portal.
§11
The Users' data made available in the Portal in the process of creating a CV will be visible only to the Employers, whereas the Employers' data made available in job, internship, and apprenticeship offers will be visible only to the Users, with the exception of data concerning the company's name, which will be visible to all visitors to the Portal, whereas the Experts' data made available in the Expert's Business Card will be visible only to the Users.
By performing the Registration, the User, Employer, or Expert agrees to the processing of their personal data to the extent necessary for the performance of the Portal services in accordance with the Regulation 2016/679 of the European Parliament and of the (EU) Council dated April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free transfer of such data and repealing Directive 95/46/EC and the Act of July 18, 2002 on the provision of electronic services by the Portal Owner, as well as by the legal successor of the Portal Owner.
During the Registration process the User, Employer, or Expert also agrees to receive system messages and information regarding the services provided to the User from the Portal, to the e-mail address provided by the User or Employer during the Registration process.
The Personal Data Administrator guarantees complete protection of the User's or Employer's e-mail addresses and ensures that these addresses will not be used to send messages to them other than those referred to in paragraph 3 of this section.
The Administrator also ensures that the e-mail address of the User, Employer, or Expert will not be made available to other entities.
The Administrator undertakes not to make User's, Employer's, or Expert's data available to entities other than those mentioned in paragraph 1 of this section and not to publish these data on other websites or portals with the exception of the Portal.
The Administrator reserves the right to interfere with the User, Employer, or Expert Account in order to remove the problem that disrupts the functioning of the Account or the Portal.
The Employer who has received application documents from Users in response to a posted offer undertakes to respect the protection of personal data and undertakes to use them only for recruitment purposes.
Copying elements of the site, information, texts, photos, or other graphic elements, as well as graphic signs posted on the site for public or commercial purposes (e.g., their use in whole, in part, or in a modified form on other websites, electronic publications, or in a material version), without the prior consent of the Administrator, is prohibited.
The User, Employer, and Expert, by submitting personal data, photos, graphic files, and materials to the Portal, agrees for them to be used by the Administrator in all fields of exploitation related to the functioning of the Portal.
§12
The User, Employer, and Expert, by placing personal data, photos, materials, and statements in the Portal, agrees for them to be used by the Administrator for recruitment campaigns carried out in the Portal.
IV. Rules of using the Portal
§13
The User, Employer, or Expert is obliged to use the Portal according to the Regulations.
Actions performed while using the Portal which violate the Regulations are considered to be, in particular:
1) actions contrary to the Polish law;
2) actions contrary to the principles of social coexistence;
3) morally reprehensible actions;
4) infringing the welfare of third parties;
5) dissemination of false personal data;
6) dissemination of information misleading other Users, in particular using a foreign identity;
7) sending messages which are for one's own marketing or commercial purposes;
8) breaching the rules of etiquette;
9) dissemination of content having a negative impact on the image of the Portal;
10) dissemination of content having a negative impact on the image of the University Management Department Users, Employers, and Experts;
11) using words commonly regarded as offensive.
In case of violation of the Regulations by the User, Employer, or Expert, the Administrator is entitled to:
1) send them an e-mail with a warning;
2) restrict their access to certain services;
3) delete data entered contrary to the Regulations;
4) modify, block or delete their Account;
5) delete entries posted in the Portal, e.g., in the forum.
Any action contrary to the Regulations, which the User, Employer, or Expert has not abandoned, despite the measures taken by the Administrator as described in paragraph 3, will be considered a gross violation.
§14
The User, Employer, or Expert will be obliged to respect the copyrights to inventions, patents, trademarks as well as utility and industrial designs of other Users, Employers, or Experts.
The User, Employer, or Expert is obliged to refrain from any action violating the privacy of other Users, Employers, or Experts. This includes collecting, processing, and disseminating information about other Users, Employers, or Experts without their consent.
The User, Employer, or Expert will not be bound by paragraph 2 of this section, provided that the activities referred to above are permitted under the Regulations and the law.
§15
It is prohibited to place in the Portal and disseminate through it:
1) software without the consent of the owners of copyrights to this software;
2) software intended for unauthorized copying, destroying, deleting, modifying, damaging, or obstructing access to computer data included in the Portal;
3) software causing interference in the work of ICT systems and networks;
4) passwords, access codes, or other data enabling illegal access to information stored in the computer system or the IT network of the Portal.
The actions referred to in section 1 are considered a gross violation of the Regulations.
§16
By uploading a photo to the Portal, the User declares that they have the necessary rights to publish the photo in the Portal and that they do not violate the rights and personal property of third parties.
By placing the logotype in the Portal, the Employer declares that they have the rights that allow him/her to publish the logotype in the Portal and do not violate the rights and personal property of third parties.
The Administrator has the right to delete the User's, Employer’s, and Expert's photos or logos uploaded by the Employer without having to give a reason or inform the User, the Employer or the Expert about it, or to force the User, Employer, and Expert to change the photo into another one.
The Administrator will not be liable for any unlawful use of the photos of Users, Employers, and Experts or logos uploaded by Employers in the Portal by third parties.
§17
The User, Employer, and Expert are obliged to enter true and current data in the Portal, including home address and e-mail.
The Administrator will not be liable for the consequences of failure to comply with the obligation specified in paragraph 1.
§18
Every User, Employer, and Expert has the right to report violations of the Regulations to the Administrator.
In order to report the infringement of the Regulations, the User, Employer, and Expert should send their applications to the Administrator's email address. The Administrator will consider the report within 7 days.
§19
The User has the opportunity to receive the Newsletter with job offers once a week on average, and the Newsletter with general information once a month on average.
The Newsletter is sent to the email address provided by the User.
The User may unsubscribe from the Newsletter at any time by editing their settings in the Portal.
V. Liability
§20
The Portal Owner does not take liability for:
1) the content and form of information placed in the Portal by Users, Employers, or Experts;
2) the content of job offers, internships and apprenticeships placed on the site directly by Employers, as well as the working conditions they offer;
3) any damage related to the use of the Portal;
4) the content of websites which are not the property of the Portal, whose links have been placed to in the Portal;
5) the accuracy of the data entered by the User in their CV.
The User, Employer, or Expert uses the content or materials published in the Portal at their own risk only.
Statements and views expressed by the Users, Employers, or Experts, placed by them in the Portal, should under no circumstances be attributed to the Portal Owner or Administrator.
The Portal Owner points out that the products and services provided by the Portal are not guaranteed in terms of their value, completeness, and usefulness.
The Portal Owner is not liable for physical and legal defects of the offered services, for the quality of free services and for the consequences of non-performance or improper performance of obligations assumed by the Users, Employers, or Experts.
The responsibility of the Portal Owner with regard to services provided for a fee is defined by special provisions on paid services in the Civil Code.
The Portal Owner does not take responsibility for the content of private messages sent by the Users and Experts via Mail.
§21
The Portal Owner will make every effort to ensure the proper functioning of the Portal.
The Portal Owner does not take responsibility for damage resulting from failures, errors and problems or breaks in the functioning of the Portal. The Portal Owner will inform the Users, Employers, and Experts about a planned break in the functioning of the Portal.
In the event that the Portal Owner receives a notice from an office or other institution regarding the illegal nature of the data contained in the Portal, the Portal Owner will not be liable to the User, Employer, or Expert for the damage caused by preventing the access to the data.
The Portal Owner will not be liable for damage caused during the use of the Portal and for unauthorized acquisition of personal data of the Users, Employers, or Experts by third parties.
In case of random events, such as: war, riots, large-scale IT failure, which the Portal Owner could not foresee, and which make it difficult to comply with the terms of the Agreement or make the functioning of the Portal impossible, the validity of the Agreement is suspended until the cessation of the consequences of these random events.
If, after the cessation of random events referred to in paragraph 5, it is impossible to continue the performance of the Agreement and the functioning of the Portal, in this case the Agreement is terminated.
§22
The Administrator is responsible for ensuring proper operation of the Portal at all times and ensuring adequate protection for the data of Users, Employers, or Experts.
The Administrator is obliged to make every effort to remove any content that is contrary to the Regulations and the law as soon as possible.
VI. Final provisions
§23
The Portal Owner reserves the right to change the provisions of the Regulations at any time, which is required to inform the Users, Employers, and Experts immediately.
All information about changes to the Regulations will be communicated through a system message sent to the e-mail address or by displaying a message with a list of the most important changes to the Regulations, when the User, Employer, and Expert first logs in the Portal, following the change of the Regulations.
The User, Employer, and Expert bears the risk of not receiving the notification referred to in paragraph 2 of this section for reasons beyond the Portal's control.
The User, Employer, and Expert may refuse to accept the changes to the Regulations. They should then inform the Portal Owner about this fact by e-mail. The effect of sending such information will be the immediate cessation of the provision of services to the User, Employer, or Expert, which are affected by the changes in the Regulations.
In case of non-acceptance of changes to the Regulations, the Portal Owner reserves the right to terminate the Agreement with immediate effect.
§24
In situations not specified in the Regulations the provisions of the Civil Code apply.
